This document constitutes a binding agreement between you and ScrapedContact, Inc. These Terms of Service are subject to our separatePrivacy Policy andData Processing Agreement. If you are in the European Union, you may also have rights under the GDPR Addendum.
By accessing, registering for, or using ScrapedContact ("Service"), you ("Customer", "You", or "User") agree to be bound by these Terms of Service ("Terms"), together with our Privacy Policy and any other policies referenced herein. These Terms constitute the entire agreement between ScrapedContact, Inc. ("Company", "We", or "Us") and you regarding the use of the Service.
If you do not agree with any part of these Terms, you may not access or use the Service. If you are accessing the Service on behalf of an organization or entity, you represent and warrant that you have the authority to bind that organization to these Terms.
By using the Service, you acknowledge that you have read, understood, and agree to be legally bound by all sections of these Terms, including the limitations of liability, indemnification requirements, and dispute resolution provisions.

ScrapedContact is a subscription-based Business-to-Business (B2B) contact data service that provides verified, professionally-curated email contact information on a monthly subscription basis. The Service is designed for legitimate business prospecting, sales research, and marketing purposes.

The Service is provided on an "as-is" basis. We reserve the right to modify, suspend, or discontinue any features of the Service at any time with reasonable notice to active subscribers (minimum 30 days for material changes).

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account or any security breach. We are not responsible for any losses resulting from unauthorized use of your account if you fail to notify us promptly.
You may not use another person's account without explicit written permission. You may not permit third parties to access the Service through your account credentials. You are responsible for all activity conducted using your account.
You agree to promptly update your account information to keep it accurate and current. If your organization's legal status changes (e.g., merger, acquisition, closure), you must notify us immediately.
ScrapedContact offers monthly subscription plans at the following pricing structure:
All prices are in US dollars unless otherwise specified. Prices and plans are subject to change with 30 days prior written notice. Price increases will apply to your next billing cycle after notice is provided.
By providing payment information (credit card, debit card, or other payment method), you authorize us to charge your payment method on a recurring monthly basis according to your subscription plan. Your subscription will automatically renew each billing cycle unless cancelled in accordance with Section 5.4.
You are solely responsible for ensuring your payment information is accurate and kept current. If your payment method fails or is declined, we may suspend your access to the Service until payment is received. We may also attempt payment recovery through other means. Any fees charged for failed payments are your responsibility.
We use PCI-DSS compliant third-party payment processors. We do not store full credit card details on our servers. Your payment information is encrypted and transmitted securely.
We reserve the right to modify subscription fees. Any price increases will be communicated to you by email at least 30 days in advance and will take effect at your next billing cycle. Your continued use of the Service after receiving notice of a price change constitutes acceptance of the new price. If you do not accept the new pricing, you may cancel your subscription before the price change takes effect under Section 5.4.
You may cancel your subscription at any time through your account dashboard or by sending a cancellation request to support@scrapedcontact.com. Cancellation takes effect at the end of your current billing period. You will retain full access to the Service until the end of your paid billing period.
There are no long-term contracts or cancellation fees. After cancellation, your account and data will be retained for 90 days, after which your account will be subject to deletion in accordance with our data retention policy.
All pricing excludes applicable sales tax, value-added tax (VAT), goods and services tax (GST), or similar taxes unless explicitly included. You are responsible for payment of all applicable taxes based on your jurisdiction. If you provide a valid tax exemption certificate, we will apply the appropriate adjustments to your billing.
We offer a 7-day money-back guarantee for new subscribers. If you are not satisfied with the Service quality within the first 7 days of your initial subscription, you may request a full refund of your subscription fee.

We reserve the right to monitor usage patterns and investigate suspected violations of this Acceptable Use Policy. We may take immediate action including account suspension, data access termination, or legal action if we detect violations.
You are responsible for reviewing the Acceptable Use Policy regularly, as we may update it to address emerging threats or compliance requirements.
You acknowledge that you are responsible for your use of all contact data provided by the Service and for ensuring that your use complies with all applicable laws and regulations. When using contact data provided by ScrapedContact, you expressly agree to:

SCRAPEDCONTACT MAKES NO WARRANTY REGARDING DATA ACCURACY, COMPLETENESS, TIMELINESS, DELIVERABILITY, OR SUITABILITY FOR ANY PARTICULAR PURPOSE. ALL CONTACT DATA IS PROVIDED "AS IS" WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED.
ScrapedContact retains all intellectual property rights in and to:
All such intellectual property is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. These Terms grant you no ownership interest in or intellectual property rights to any ScrapedContact materials.
ScrapedContact grants you a limited, non-exclusive, non-transferable, revocable license to use the contact data provided through the Service solely for your internal business purposes as authorized in your subscription plan. This license is personal to you and may not be sublicensed, transferred, or assigned to any third party.
The contact data is licensed to you, not sold. You may not:
Upon termination or expiration of your subscription, your license to use the contact data immediately terminates. You must cease all use of the data and should delete all copies from your systems, except as required by law or for archival compliance purposes.
Any notes, tags, custom lists, or other content you create within the Service remains your property. However, you grant ScrapedContact a non-exclusive license to use such content to improve our Service, provided such use does not disclose your proprietary information.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SCRAPEDCONTACT AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE TO YOU FOR:
This limitation applies regardless of the legal theory (contract, tort, strict liability, or otherwise), and whether or not ScrapedContact has been advised of the possibility of such damages.
Notwithstanding any other provision of these Terms, our total aggregate liability to you for any and all claims arising from or related to these Terms or your use of the Service shall not exceed the total amount you paid to us for the Service in the 12 months immediately preceding the claim.
If you have not paid us anything during the preceding 12 months, our maximum liability shall be limited to $100 USD.
You acknowledge that these limitations of liability are essential terms of this Agreement and that ScrapedContact would not provide the Service without these limitations.

You agree to indemnify, defend (with counsel acceptable to us), and hold harmless ScrapedContact, Inc., its officers, directors, employees, agents, affiliates, and successors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from or related to:

We may terminate or suspend your Service subscription without cause, provided we give you 30 days written notice and allow you to cancel without penalty during such notice period.
Upon termination or expiration of your subscription:
If we terminate your account for violation of these Terms or applicable law, you are not entitled to any refund of prepaid subscription fees. We may offset any damages you owe us against any remaining prepaid fees.
We reserve the right to modify, enhance, or discontinue the Service (or any part thereof) at any time. For material changes that materially reduce the functionality provided under your subscription tier, we will provide at least 30 days written notice. You may cancel your subscription without penalty during such notice period if you are unsatisfied with the changes.
We reserve the right to modify these Terms at any time. We will notify you of any material changes by:
Your continued use of the Service after changes to these Terms constitutes acceptance of those changes. If you do not agree with the modified Terms, you must cancel your subscription before the changes take effect.
We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Service or any modification to these Terms.
ScrapedContact shall not be liable for any failure or delay in performance of its obligations hereunder caused by circumstances beyond its reasonable control, including but not limited to:
In the event of force majeure, we will make reasonable efforts to resume service as quickly as possible. Your subscription may be extended by the duration of the force majeure event if we experience service interruptions.
The Service may integrate with or provide links to third-party services, platforms, or websites. ScrapedContact is not responsible for:
Your use of third-party services is subject to their respective terms and privacy policies, which you should review independently.
Inclusion of links to or integration with third-party services does not constitute an endorsement of such services or any content therein.
These Terms, together with our Privacy Policy, any Data Processing Agreement, and any other policies referenced herein, constitute the entire and exclusive agreement between you and ScrapedContact regarding the Service and supersede any prior communications, negotiations, or agreements.
If any provision of these Terms is found to be unlawful, unenforceable, or invalid by a court of competent jurisdiction, such provision shall be severed or limited to the minimum extent necessary so that the remaining provisions shall remain in full force and effect. To the extent a provision is found partially invalid, it will be enforced to the maximum extent permitted by law.
Our failure to enforce any provision of these Terms shall not constitute a waiver of our right to enforce such provision or any other provision. No waiver of any breach shall be effective unless made in writing and signed by our authorized representative.
These Terms and your use of the Service shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflicts of law provisions.
Notwithstanding the above, if you are a consumer located in the European Union, European Economic Area, or Switzerland, you retain the right to bring claims in your home jurisdiction and may be entitled to the protection of mandatory consumer protection laws in your jurisdiction that cannot be waived by agreement.
The Service is subject to US export control laws, including the US Export Administration Regulations (EAR). You agree not to access, use, or provide the Service to any person or entity in any jurisdiction that is subject to US export sanctions or embargoes, or to any person or entity on any US sanctions lists (OFAC, etc.).
Before initiating formal dispute resolution proceedings, you agree to attempt to resolve any dispute informally by sending detailed written notice to our legal team at legal@scrapedcontact.com. You agree to provide:
We will respond within 30 days with our position and proposed resolution. Both parties agree to negotiate in good faith for 60 days before initiating formal proceedings.
If your dispute with ScrapedContact is not resolved through informal negotiation, any claim or dispute (except those listed in Section 20.3) shall be resolved by binding arbitration administered by JAMS (Judicial Arbitration and Mediation Services) under its Comprehensive Arbitration and Mediation Services Rules and Procedures.

YOU AGREE THAT ANY ARBITRATION OR COURT PROCEEDING SHALL BE CONDUCTED ON AN INDIVIDUAL BASIS AND NOT AS A CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE ACTION. You waive your right to participate in class arbitration or class litigation. Any dispute must be brought in the name of the individual claimant only, and not on behalf of any other person or entity. The arbitrator may not consolidate claims of multiple individuals.
If you are a resident of the EU/EEA, you may have the right to bring legal proceedings in your home jurisdiction notwithstanding the arbitration provision above. Consumers in the EU/EEA are entitled to mandatory consumer protections under EU law that may not be waived.

ScrapedContact is not responsible for any individual's privacy expectations or complaints regarding your use of their contact information. You are fully responsible for managing any privacy inquiries or complaints from data subjects.
